  1. General


1.1. The landlord undertakes to hand over the holiday apartment – hereinafter also referred to as rental property – to the tenant in a clean and perfect condition at the agreed time.

1.2. The apartment is rented to ____ people.

The tenant may not sublet the holiday home to third parties or allow it to be used. The tenant may not accommodate more people in the holiday home than agreed in this contract without the written consent of the landlord.


1.3. Pets are not allowed.

1.4. Smoking is not permitted.





2. Rental property


2.1. The rental property is a holiday apartment on the 1st floor with two bedrooms, two bathrooms, kitchen, living and dining room and two balconies. Total area approx. 85 sqm.

2.2. The apartment is fully furnished and equipped. A basement compartment and an underground car park space are also available for use.

2.3. The tenant will be given 2 keys. These close the front and apartment doors, as well as the basement compartment and the underground car park gates.



3. Rental Period


3.1. The apartment is rented for a period of _____ nights.

4. Rental Price

4.2. The rental price includes all additional costs and final cleaning.

4.3. The local tourist tax in Garmisch-Patenkirchen is not included in the rental price. This will be charged separately.

In return, the tenant receives a guest card for all persons, which entitles them to discounts on many facilities and offers.


4.4. 50% of the rental price is due 14 days after the rental agreement has been signed.

5. Withdrawal


5.1. The tenant can withdraw or terminate the rental agreement in writing. The landlord tries to find another tenant.

5.2. If no replacement tenant can be found before the agreed start of the rental period, the original tenant is obliged to pay compensation to the landlord.

The compensation is staggered as follows:


- 14-35 days before arrival 50% of the rental price

- 7-13 days before arrival 75% of the rental price

- 0-6 days before arrival 90% of the rental price


5.3. If the tenant breaks off the stay prematurely, he remains obliged to pay the full rental price.





6. Disposal


7.1. The tenant undertakes to separate the garbage that accumulates during the rental period and to dispose of it in the garbage containers in the basement.





7. Lessee's duty of care, liability


8.1. The tenant must treat the rented property, including the inventory, with care and encourage fellow residents and visitors to do so.

The tenant will be given the house rules. The tenant undertakes to comply with these house rules.

8.2. The lessee is liable for damage caused culpably by him, by devices operated by him, by his vicarious agents or by persons who are in the rented property with the knowledge and will of the lessee - due to breach of his duties of care and due diligence .

8.3. The tenant undertakes to be considerate of the neighbors when using the holiday apartment. The quiet times from 12:00 p.m. to 3:00 p.m. and from 10:00 p.m. to 7:00 a.m. must be observed. Especially on Sundays and public holidays.

8.4. Defects that are discovered when taking over the property and/or during the rental period must be reported to the landlord immediately. The tenant is obliged to report any damage to the rental property or household effects caused by himself or the flatmates to the landlord immediately.




8. Termination of Lease


8.1. The rental relationship ends after the agreed rental period has expired.



9. Return of the rental property


9.1. The tenant has to hand over the holiday apartment in a clean condition at the end of the rental period.

Used crockery, cutlery, pots, pans and glasses are to be cleaned and put away.




10.Final Provisions


10.1. Verbal collateral agreements do not exist. This contract is subject to the law of the Federal Republic of Germany.
